The Canary Islands Holiday Rental Association (ASCAV) has lodged a complaint with the European Commission against the Government of the Canary Islands, alleging a "flagrant violation" of European regulations in the processing of the new Sustainable Management of Tourist Use of Housing Law.
According to a statement released by the organisation today, Wednesday, ASCAV argues that the law breaches Article 15.7 of Directive 2006/123/EC of the European Parliament and the Council, which concerns services in the internal market.
This directive requires EU Member States to notify the European Commission of any new legal, regulatory, or administrative provisions that impose restrictions or limitations on the free provision of services, conditions that, according to ASCAV, apply to the new regulations on holiday rentals in the Canary Islands.
"This issue was already raised by the Canary Islands’ Department of Finance and EU Relations during the drafting phase of the bill. However, the Department of Tourism ignored these concerns, thereby violating a fundamental obligation within the European framework," the association stated in its complaint.
