European arrest warrant issued for the mother of Alena for ‘parental abduction’

The Courts in Güímar have issued a European arrest warrant for the mother of two-year-old Elena for ‘parental abduction’, after the young girl's father reported her missing from Tenerife at the beginning of the month.

The court found out that Alena was on holiday with her mother who promised the judge that she would bring her back on August 12th. For this reason, at that time, the magistrate dismissed the father's request to issue an arrest warrant and withdraw custody of the girl Alena. However, that has now changed because Alena hasn’t come back yet.

After having a video call with Alena’s mother, the judge concluded that there was "no objective and real risk for the minor", as she was "accompanied by her mother and is being well cared for", and not in a helpless situation.

In addition, the mother showed them a return ticket, for her and her daughter, from Barcelona to Tenerife, scheduled for August 12th, and transmitted to the court her intention to deliver the minor to the father at the beginning of her vacation period this month.

All this revealed "an absence of real danger to the well-being and health of the minor, as well as the absence of criminal activity," the judge reasoned in her order, who nevertheless decreed as a precautionary measure the annulment of the girl's passport once she returned to Tenerife, and a ban on her leaving the island in the future.

In addition, it established that the delivery and collection of the minor would take place at the ‘Family Meeting Point’ in Santa Cruz de Tenerife. Finally, the judge warned that if Alena was not returned on that day, they would have no choice but to take further action, which is what has happened.
