Galicia, Aragon, the Balearic Islands, Murcia, Catalonia, and Navarra already have the endorsement of their Superior Courts of Justice to impose the COVID passport in their regions for people to access certain spaces in the face of the upturn in coronavirus cases that is occurring across the country.
Others, such as the Valencian Community, have already requested their endorsement from the courts and are awaiting the decision. Meanwhile, the Basque Country has chosen to appeal against the initial resolution of their Superior Court of Justice that prevented the implementation of the COVID certificate in leisure and catering.
REGIONS IN WHICH IT IS CURRENTLY APPLICABLE:
In Catalunya, the use of the COVID certificate is now in force in nightlife, in the interiors of restaurants (not terraces), gyms, and homes for the elderly. It also extends to cinemas, theatres, auditoriums. However, the Government has suspended the obligation to present it until, at least, tomorrow (Monday), due to the collapse of the website to download it,
In Navarra, the court has authorized its use to access restaurants with a capacity of more than 60 diners, establishments with a disco license or party rooms, and mass events of a cultural nature in interior spaces with the consumption of food or drink for more than 1,000 people. The COVID passport will take effect from now until January 7th.
In Aragon it is mandatory to present it in nightlife establishments (party rooms, dance halls); celebrations of all kinds that may take place in hospitality and restaurant establishments, and mass events with more than 500 attendees indoors, or 1,000 attendees outdoors or in open-air venues.
Galicia has obtained the green light from the court to request the COVID certificate inside restaurants and from 9:00pm at night in bars and cafes. In addition, it requires the COVID passport in night establishments, in hostels, and for hospital visitors.
In Murcia, the Higher Court of Justice has endorsed the extension of requiring a COVID certificate for customers of premises that reach 100% capacity and will be in force until December 17th.
The Balearic Islands. The Superior Court of Justice of the Balearic Islands authorized the Government in October to require the COVID certificate to be able to access nightlife venues and nursing homes on the islands. At the moment it is valid until December 8th.
REGIONS PENDING THE DECISION OF THE COURT OF JUSTICE:
The Valencian Community has asked the Superior Court of Justice of the Community for the endorsement for its implementation as of December 3rd for 30 days. It will be mandatory to present the document in hospitality establishments with a capacity of more than 50 people, in entertainment venues (discos, nightclubs, pubs), in recreational venues with hospitality services such as bingo halls or casinos, and in hospitals and nursing homes for visitors.
The Government of the Canary Islands will send a proposal for judicial ratification by which the certificate can be requested in all spaces of public use, whose managers voluntarily require it from both staff and clients. If the order is ratified by the Superior Court, these spaces for public use may function with the capacity and limitations of the level immediately below the one the island is in. This measure is intended to be used until January 15th.
