The Superior Court of Justice of the Canary Islands (TSJC) has decided not to approve the extension of the voluntary use of the Covid Certificate to take advantage of capacities and closing times in the level below. This means that hospitality and nightlife venues will have to close at the specified time of the level that the island is in.
Last week the Governing Council abolished mandatory use to leave it up to businesses to decide if they wanted to request it voluntarily and have some advantages, but the TSJC has said no.
This means that the closing times from today stay as follows:
Level 4: midnight
Level 3: 2am
Level 2: 3am
Level 4: 4am
This is a blow to bars and nightlife venues in Level 4 who were hoping to be able to stay open later, however, it is possible that Tenerife particularly could move to Level 3 this afternoon which would mean more capacity and later closing anyway.
TSJC STATEMENT:
The TSJC has released a statement explaining why they have had no choice but to refuse approval of voluntary use of the Covid Certificate for businesses that wanted to use capacities and closing times of the level below. It says that they have been asked to extend a measure that expired at midnight last night.
“It is not possible to ratify the extension of measures that have ceased to be effective, and this one expired at 11.59pm yesterday, February 9th, 2022," alleges the Contentious Chamber.
In reality, the magistrates acknowledge that the Government of the Canary Islands submitted its request on time, on the 7th, and that the TSJC has ruled within the three days granted by law, but at a time when it is no longer possible to extend what Legally it is not valid.
