Canary Islands Residents Warned over Air Conditioning Fines up to €3,000

Homeowners in the Canary Islands are being warned they could face fines of up to €3,000 for installing air conditioning units incorrectly on apartment buildings and residential properties.

With summer approaching, demand for air conditioning systems is rising sharply, but experts are reminding residents that strict rules apply when placing external compressor units on building façades.

Under Spain’s Ley de Propiedad Horizontal, building façades are considered communal property, meaning homeowners cannot legally alter them without prior approval from the community of owners.

That means installing a visible outdoor air conditioning unit without permission could result in legal action from neighbours, forced removal of the system, and costly penalties.

Local councils can issue fines

As well as community rules, local councils across the Canary Islands also enforce urban planning and environmental regulations covering the appearance of buildings, noise pollution and water drainage from air conditioning systems.

In many municipalities, outdoor units must be hidden from public view and placed in locations such as internal patios, rooftops or screened terraces.

The restrictions are even tighter in protected historic areas, where visible compressors may be treated as serious urban planning violations.

According to the report, fines can range from a few hundred euros for minor breaches up to €3,000 for more serious offences.

Noise and leaking water also targeted

Authorities are also cracking down on excessive noise from compressor units and water dripping onto public pavements.

If neighbours complain about noise levels, Local Police can request official sound measurements which may lead to sanctions if legal decibel limits are exceeded.

Meanwhile, draining condensation water directly onto streets or pavements is prohibited in most Canary Islands municipalities because it creates slip hazards and damages public surfaces.

What residents should do before installing air conditioning

Homeowners are recommended to take several steps before arranging installation:

  • Check community statutes for any existing rules
  • Obtain formal approval from the owners’ association if required
  • Consult local council urban planning departments about restrictions
  • Ensure drainage and noise regulations are fully complied with
  • Use a reputable company that is aware of the correct legislation and can find out these stipulations for you

Failure to follow the rules could result not only in financial penalties, but also court action and the forced removal of the system at the owner’s expense.
