Court rules Siam Mall expansion illegal

A court ruling has declared nearly 2,500 square metres of additional retail space at Siam Mall in Adeje unlawful, after finding the planning mechanism used to approve the expansion did not meet legal requirements. The decision could have implications for how developments are approved in one of South Tenerife’s busiest tourist areas.

The High Court of Justice of the Canary Islands ruled that Adeje Town Hall incorrectly authorised the expansion of the shopping centre using a specific urban planning tool that was not intended for that purpose. The extension, carried out between 2023 and 2024, added almost 2,500 square metres and allowed for seven new retail units and the arrival of several international brands.

The project was approved under a Plan for Action in the Urban Environment, a mechanism designed to address urban areas suffering from deterioration or lack of infrastructure. However, the court found no such conditions existed at Siam Mall, meaning the legal basis for using this tool was invalid.

Judges concluded that the real aim of the plan was to increase commercial space rather than improve public facilities, which is a key requirement under the law. They also stated that the council had effectively reversed the proper legal process, using the plan as a shortcut to modify development rules without following the correct procedures.

The ruling followed a legal challenge brought by the Canary Islands Government, which argued that the planning approval lacked justification. The court upheld this claim in 2024 and ordered the decision to be annulled, with costs awarded against Adeje Town Hall.

Although the council attempted to appeal to the Supreme Court, the case was dismissed in September 2025. Judges ruled the appeal did not meet the necessary criteria, meaning the earlier decision is now final.

While the shops remain open, the case raises questions about future expansions and planning approvals in the area.
